Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Aankhiya ("the Platform"), including our website at https://aankhiya.com, our mobile and connected-TV applications, and every feature, content item and service offered through them.
The Platform is owned and operated by BLUEE HORSE CINEMA PRIVATE LIMITED ("we", "us", "our"), a company incorporated under the Companies Act, 2013, having its registered office at E 306, Sonam Srivilas, Golden Nest Phase 15, Opposite Mithalal Jain Bungalow, Bhayander East, Thane 401105, Maharashtra, India.
By creating an account, subscribing to a plan, or otherwise using the Platform, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy and Refund Policy. If you do not agree, please do not use the Platform.
1. Eligibility
1.1 You must be at least 18 years of age, and competent to contract under the Indian Contract Act, 1872, to create an account or purchase a subscription.
1.2 If you are under 18, you may use the Platform only under the supervision of a parent or legal guardian who accepts these Terms on your behalf.
1.3 Certain content on the Platform is age-restricted or classified as mature. You must not access such content if you do not meet the stated age requirement.
2. Your Account
2.1 You must provide accurate and complete information when registering, and keep it up to date.
2.2 You are responsible for maintaining the confidentiality of your account credentials and one-time passwords, and for all activity that takes place under your account.
2.3 An account is for your personal use only. You must not sell, transfer, rent or share your account or credentials with any other person.
2.4 Notify us immediately at support@aankhiya.com if you suspect unauthorised use of your account.
2.5 We may suspend or terminate an account that is used in breach of these Terms, that shows signs of credential sharing or commercial redistribution, or where required by law.
3. Subscriptions, Plans and Billing
3.1 Access to some or all content requires a paid subscription. The plans, prices, billing period, applicable taxes and the extent of access are shown on the plan page before you pay.
3.2 All prices are in Indian Rupees (INR) unless stated otherwise, and are inclusive of applicable taxes unless stated otherwise.
3.3 Payments are processed by third-party payment gateways. We do not store your full card, UPI or bank credentials.
3.4 Where a plan is set to renew automatically, it will renew at the end of each billing period at the then-current price until you cancel. You may cancel auto-renewal at any time from your account settings or through the app store you subscribed via; cancellation stops future renewals and takes effect at the end of the current paid period.
3.5 Subscriptions purchased through the Apple App Store or Google Play are governed additionally by the billing and cancellation rules of that store.
3.6 We may revise plan prices or plan benefits. Changes apply from your next billing period, and we will give you notice before they take effect.
3.7 All payments are final. Please read our Refund Policy, which forms part of these Terms - we do not offer refunds or cancellations of amounts already paid.
4. Licence to Use the Platform
4.1 Subject to these Terms and to payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to stream content on the Platform for private, non-commercial viewing.
4.2 Content is licensed, not sold, to you. You acquire no ownership rights in any content.
4.3 Content availability varies by plan, device, geography and licensing window, and may change or be withdrawn at any time.
5. Restrictions
You must not, and must not permit any other person to:
5.1 copy, record, download (except through a download feature we expressly provide), reproduce, republish, broadcast, publicly perform or distribute any content from the Platform;
5.2 circumvent, disable or interfere with digital rights management, geo-restrictions, watermarking, or any security or access-control technology used by the Platform;
5.3 use any robot, scraper, crawler or automated means to access the Platform or collect data from it;
5.4 reverse engineer, decompile or disassemble any part of the Platform, except to the extent this restriction is prohibited by law;
5.5 use the Platform for any unlawful, infringing, defamatory, obscene or fraudulent purpose, or in a manner that violates the Information Technology Act, 2000 and the rules made under it;
5.6 upload or transmit any virus, malware or other harmful code, or attempt to gain unauthorised access to the Platform, its servers or another user's account;
5.7 resell, sublicense or commercially exploit access to the Platform or its content, including by screening content in a public or commercial place.
6. Intellectual Property
6.1 The Platform, its software, design, trade marks, logos, and all content made available on it are owned by BLUEE HORSE CINEMA PRIVATE LIMITED or by its licensors, and are protected by the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable laws.
6.2 Nothing in these Terms transfers any intellectual property right to you.
6.3 If you believe content on the Platform infringes your copyright or other rights, write to our Grievance Officer at support@aankhiya.com with details of the work, the location of the allegedly infringing material, and a statement of your rights.
7. User Content and Conduct
7.1 If the Platform allows you to submit reviews, comments, feedback or other material ("User Content"), you remain responsible for it and confirm that you have the right to submit it.
7.2 You grant us a worldwide, royalty-free, non-exclusive licence to host, store, reproduce and display your User Content for the purpose of operating and promoting the Platform.
7.3 We may remove User Content that breaches these Terms or applicable law, without prior notice.
8. Content Classification and Viewer Discretion
8.1 Content on the Platform is classified in line with applicable self-regulation requirements for publishers of online curated content, and each title carries an age rating and, where relevant, a content descriptor.
8.2 Parental controls and profile-level restrictions, where available, should be used to restrict access by minors. You are responsible for supervising use of the Platform by anyone you allow to use your account or device.
9. Third-Party Services and Links
The Platform may link to or integrate third-party services (payment gateways, app stores, analytics, social sign-in). We are not responsible for the content, policies or practices of those services, and your use of them is governed by their own terms.
10. Availability, Changes and Suspension
10.1 We aim to keep the Platform available, but we do not guarantee uninterrupted or error-free access. Streaming quality depends on your device, network and internet speed, which are your responsibility.
10.2 We may modify, suspend or discontinue any part of the Platform, or any title or feature, at any time, including for maintenance, security, legal or licensing reasons.
11. Disclaimers
11.1 The Platform and its content are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, to the maximum extent permitted by law.
11.2 We do not warrant that the Platform will meet your requirements, or that defects will be corrected.
12. Limitation of Liability
12.1 To the maximum extent permitted by law, BLUEE HORSE CINEMA PRIVATE LIMITED and its directors, employees and licensors will not be liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, data or goodwill, arising out of your use of or inability to use the Platform.
12.2 Our total aggregate liability arising out of or in connection with these Terms will not exceed the amount you paid to us for the subscription in the three (3) months immediately preceding the event giving rise to the claim.
12.3 Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Indemnity
You agree to indemnify and hold harmless BLUEE HORSE CINEMA PRIVATE LIMITED, its directors, employees, agents and licensors from any claim, demand, loss or expense (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Platform or its content.
14. Termination
14.1 You may stop using the Platform at any time and may delete your account from your account settings or by writing to support@aankhiya.com.
14.2 We may suspend or terminate your access, with or without notice, if you breach these Terms, if we suspect fraud or unauthorised use, or if required by law.
14.3 Termination does not entitle you to any refund of amounts already paid. Clauses that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity and governing law) will survive.
15. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date, and material changes will be notified to you where required. Continued use of the Platform after the change takes effect means you accept the revised Terms.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of India. The courts at Thane, Maharashtra, will have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Platform.
17. Grievance Redressal
In accordance with the Information Technology Act, 2000 and the rules made under it, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2020, the Grievance Officer for the Platform is:

Complaints are acknowledged within 24 hours and resolved within 15 days of receipt, or within such shorter period as the applicable law requires.
